Terms of Service

1. Who we are

zerochill.com and the Zero Chill games, apps and events (the "Service") are run by Zero Chill ("Zero Chill", "we", "us"). By creating an account or using the Service, you agree to these Terms of Service, our Privacy Policy and our Refund Policy. If you do not agree, do not use the Service.

2. Who can use the Service

• You must be at least 13 years old to create an account.
• If you are under 18, you need permission from a parent or guardian to use the Service and to make any purchase. Your parent or guardian agrees to these Terms on your behalf and is responsible for your purchases.
• You may not use the Service where it is not allowed by local law. Some features, such as prizes, may not be available in every country.
• One account per person. You are responsible for everything that happens under your account and for keeping your sign-in details private.

3. Games, scores and Proof of Play

• Zero Chill games are games of skill. Scores, ranks and leaderboards reflect gameplay only.
• Some gameplay can earn Proof of Play credit through the Zero Chill Chill Meter. Proof of Play is earned only by playing. It cannot be bought, and no purchase of Shards, boosts or any other item increases it.
• Proof of Play and any mining rewards connected to it are provided through separate services (mineZCU and Honest Money) under their own terms. Those terms govern any rewards, wallets and payouts.

4. Shards

Shards are a virtual in-game item used only inside the Service.

• Shards have no cash value. They cannot be exchanged, sold or redeemed for money, cryptocurrency or anything outside the Service.
• Shards cannot be transferred, sent or sold to another player or account. Gifts sent inside the Service use up the sender's Shards; they do not create Shards the recipient can cash out or pass on.
• When you buy Shards you receive a limited, personal, revocable license to use them inside the Service. You do not own them, and they are not a deposit, stored value or a financial product.
• We may change Shard prices, the items Shards unlock and how Shards work, and we may end Shards entirely, with reasonable notice where the law requires it.
• Shards may be removed if they were obtained through a bug, fraud, a reversed payment or a breach of these Terms.

5. Purchases

• You can buy Shards and digital items such as avatars, banners, frames, name styles and boosts. Prices are shown before you pay and include any fee we charge.
• Payments are handled by our payment processors. We do not store your full card details.
• Digital items are delivered to your account right away. Because of that, purchases are final except as described in our Refund Policy or required by law.
• You confirm that you are allowed to use the payment method you choose.

6. Events and prizes

• Some events offer prizes, such as Shards or physical items. Each event has its own official rules, which apply together with these Terms.
• No purchase is ever needed to enter an event or win a prize, and buying Shards, boosts or any item never improves your chance of winning a prize or the size of a prize.
• Employees, contractors and test accounts of Zero Chill may play in events but cannot win prizes.
• We check results before paying prizes and may disqualify accounts that cheat, use several accounts, use bots or scripts, or exploit bugs.
• Physical prizes are shipped to the address you give us. Some items are made to order, so delivery can take time.

7. Rules of conduct

You agree not to:

• cheat, use bots, scripts or modified clients, or exploit bugs;
• create or use more than one account, or share or sell accounts;
• harass, threaten or abuse other players, or post unlawful, hateful or sexual content;
• interfere with the Service, its security or other players' use of it;
• use the Service for any unlawful purpose.

We may warn, suspend or close accounts that break these rules, and remove Shards, items, scores or prizes connected to the breach.

8. Ads and notifications

Some games show ads, including optional ads you can choose to watch for an in-game reward. If you allow it, we may send push notifications and emails about your account, events and offers. You can turn these off in your device or account settings, or by unsubscribing.

9. Our content

The games, characters, artwork, names and other content in the Service belong to Zero Chill or its licensors. You may use them only to play and enjoy the Service. Content you create in the Service, such as a profile name, must be yours to share, and you let us display it in the Service.

10. Other services

The Service links to services run by others, including Honest Money and mineZCU for sign-in, Proof of Play and mining, and our payment processors. Those services have their own terms, and we are not responsible for them.

11. Disclaimers

The Service is provided "as is" and "as available." We do not promise that it will always be available, error-free or secure, or that any feature, event or item will continue. To the fullest extent the law allows, we disclaim all implied warranties.

12. Limits on our liability

To the fullest extent the law allows, Zero Chill is not liable for indirect, incidental or consequential losses, or for lost data, profits or goodwill. Our total liability for any claim about the Service is limited to the amount you paid us in the 6 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

13. Ending your account

You can stop using the Service and ask us to close your account at any time. We may suspend or close your account if you break these Terms or if we have to by law. Unused Shards and items are lost when an account is closed, except where the law requires otherwise.

14. Disputes and governing law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules. Before filing any claim, please contact us so we can try to resolve it. Any court case will be brought in the state or federal courts located in Wyoming, unless the law where you live gives you the right to bring it locally.

15. Changes

We may update these Terms. If a change is significant, we will give notice on zerochill.com or by email before it takes effect. Continuing to use the Service after that means you accept the updated Terms.
